Common Area Restrictions
RULES & REGULATIONS
1. Uses
a. Town Homes: Common Areas shall not be used except for recreation, beautification or amenity purposes. Areas between end-of-group homes should be used for ingress and egress to the rear of the homes. Recreational activities should be conducted in larger Common Areas away from homes.
b. Single-Family Homes: Common Areas shall not be used except for beautification purposes. All trees, including young saplings, must remain. Residents are not permitted to clear wooded common areas without prior written permission from the Box Hill South Homeowners Association (BHS-HOA).
2. Activities
No noxious or offensive activities shall be carried on or upon any of the Common Areas, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. Ground conditions must be such that no damage will occur to the common areas during any activity. Should damage occur, the individual (s) responsible will be held financially responsible.
3. Beautification
Any homeowner wishing to install any plantings or beautification on any Common Areas near their homes must first get written approval from the Board of BHS-HOA.
4. Signs
No sign of any kind shall be displayed to the public view on any lot except (a) one (1) sign of not more than five square feet (5 sq. ft.) advertising the property for sale or rent or (b) signs used by a builder or developer to advertise the property during the construction and sales period.
5. Trash & Storage
None of the Common Areas shall be used or maintained as a dumping ground for rubbish, trash, garbage, yard waste & grass clippings nor shall other waste be kept thereon, except in sanitary containers, in the trash collection areas on trash days. Personal belongings (i.e. firewood, building materials, children's toys or any other personal belongings of a Lot or Member) shall not be kept or stored on the Common Areas.
6. Parking Areas:
a. Town Homes & Single-Family Homes:
i) No inoperable, disabled, abandoned, unregistered, or not currently registered vehicle shall be kept on any designated parking area.
ii) No major vehicle repairs shall be carried out on any Lot or any of the Common Areas or on parking spaces provided.
iii) Campers, RV's, boats, trailers, recreational equipment, or the like shall only be parked or placed on private driveways of single-family homes and shall be limited to one (1).
iv) No double parking shall be allowed throughout the community.
v) Any vehicle parked in other than designated parking areas or in violation of these rules is subject to removal at the owner's sole risk and expense. Notice under this provision shall be deemed as being provided. Those vehicles parking in violation will be towed to:

vi) Homeowners and tenants alike shall be responsible for informing their guests of the community parking policy.
vii) No motorized vehicles shall be driven on the "non-asphalt" common areas except for deliveries. Vehicles are not permitted on any Common Areas without the written prior consent of the Board for BHS-HOA.
b. Town Homes Only:
i) No vehicle shall exceed ¾ ton capacity or the length or width of the parking space. Vehicles shall not take up more than one parking space.
ii) Campers, RV's, boats, trailers, recreational equipment, or the like are prohibited in the Town Home area including courts, parking pads, public roads, common areas and private lots.
iii) No vehicles shall restrict the flow of pedestrians on the sidewalk.
iv) Parking in Common Areas in front of the homes should permit one (1) parking space per home. It shall be deemed a common courtesy to allow residents to park as close to the front of their home as possible. Additional parking is on a first-come, first-serve basis in the overflow parking areas. Anyone owning more than two (2) vehicles should park these additional vehicles on county roads.
v) Homeowners desiring assigned parking spaces may petition the homeowners in the court. A majority of homeowners must be in favor of an assigned parking plan. The Association will implement a parking plan.
7. Commercial Activities
No part of the Common Areas shall be used for commercial activities of any character unless approved in writing by the Board of Directors for BHS-HOA in advance.
8. Insurance
No one shall alter or use any Common Area in a manner, which may increase the rate of insurance on the Common Areas, result in the cancellation or non-renewal of insurance thereon without the written consent of the Board of Directors for BHS-HOA.
Lot Restrictions
RULES & REGULATIONS
1. Residential Use
All lots are to be used for residential purposes exclusively, except for such secondary uses as may be permitted by the Board of Directors from time to time.
2. Use Restrictions
No noxious or offensive trade or activity shall be carried on or within any Lot, nor shall anything be done therein or thereon which may be or become an annoyance to the neighborhood or to other owners.
3. Insurance
Nothing shall be done or maintained in or on any Lot, which will increase the rate of insurance on any Lot or the Common Areas, or result in the cancellation of insurance thereon. Nothing shall be done or maintained on any Lot, which is in violation of any law.
4. Trash & Recycling
a. No burning of trash and no unreasonable or unsightly accumulation or storage of litter, new or used building materials or trash of any kind shall be permitted within or on any Lot or Common Areas. Trash and garbage containers shall not be permitted to remain in front or side yards. All trash will be placed on sidewalks at curbside or on grassed Common Areas near curbside. Trash must be kept in a sealed container only.
b. Trash and recycling starts as early as 6 AM so trash should be placed out for collection before 6 AM the morning of trash collection or after dusk the evening before trash collection.
c. Example: Trash is currently picked up twice a week on Monday & Thursday. Recycling is every Monday (along with regular trash pick-up). Paper, along with bottles & cans, are done on a weekly rotation basis. Harford Sanitation can be called at 410-838-5472 for specific inquiries.
5. Loud Noises
No loud or unusual noises are permitted. Musical instruments and/or other elctronically amplified sound producing devices shall only be used in such manner as not to disturb persons on other Lots or any Common Areas.
6. Lot Maintenance
The owner of each Lot shall keep his Lot, and all improvements thereon, in good order and repair, including but not limited to the seeding, watering and mowing of all lawns and yards, keeping all walkways neat, clean and in good repair. All owners are responsible for the pruning and cutting of all trees and shrubbery along with the painting (or other appropriate external care) of all buildings and structures on the Lot to include mailboxes for single-family homes.
7. Snow & Ice Removal
All sidewalks directly in front of each Lot must be cleaned of ice and snow within 24 hours after precipitation has ended. Homeowners are encouraged to clear ice and snow off sidewalks in such a manner as not to damage sidewalk surface. Any damage to sidewalks surface as a result of now and ice removal will be the financial responsibility of the owner of the Lot owner. Please refrain from using salt or rock salt, as it can cause deterioration of the concrete resulting in permanent damage to the concrete and eventual replacement. Some alternatives are calcium chloride, sand, and kitty litter.
8. Pets
The maintenance, keeping, boarding and/or raising of animals, livestock, or poultry of any kind, regardless of number shall be and is hereby prohibited on or within any Lot. Pets must be kept inside its respective Owner's Lot and may be walked on Common Areas only on a leash. No pet may be permanently staked to a fixed object in, about, or on a Lot or the Common Areas. Pet owners are required to take immediate steps to remove pet waste from the Lots and Common Areas in an appropriate and sanitary manner. Pet owners are responsible for the cost of repairing all damage, destruction or litter sustained in the Common Areas or other Lots as a result of their pet's activities. Pet owners shall not own or harbor a pet, which disturbs the peace and quiet of the neighborhood or which is vicious and a danger to any person. After three (3) complaints of disturbance the animal/pet in question may ask to be removed.
9. Pet Houses
Pet houses may be placed on any Lot but not in the Common Area. They must either be a natural wood color or match the color of the house, and the lot shall be enclosed with a fence.
10. Signs
No sign of any character shall be erected, posted or displayed upon, from or about any Lot. Exceptions shall be as follows:
a. Advertisement of a property by a builder during construction and sales period.
b. Advertisement of a home improvement service during the construction. Sign must be removed one (1) week after completion of such service.
c. One (1) sign 'For Sale' or 'For Rent' may be displayed in the front yard or front window while the house is on the market for sale or when the owner is trying to fill a vacancy for rent.
d. Yard sale signs must be removed from owner's lots and all common areas immediately after termination of sale.
e. Temporary announcement signs (birth announcements) are permitted.
11. Alterations
No alterations, construction, addition, remodeling or removal on any Lot shall be commenced or conducted except in strict accordance with the provisions of the Declaration aforesaid and the Articles of Incorporation and By-laws of the Box Hill South HOA.
12. Satellite Dishes
Satellite dishes not to exceed 18" in diameter are permitted to be installed as outlined by the FCC. The placement of these dishes is, however, subject to the approval of the Board of Directors for Box Hill South HOA. A written application showing the location desired for installation must be submitted to the Board before installation begins. A written approval from the Board will be sent via mail to the homeowners once the Board has approved the location.
13. Attic Fans
Attic fans shall be allowed only on the back slope of the roof and two to four feet from the peak. Fans shall be black in color. Wind turbine and gable mount attic fans shall not be allowed. Only roof mount attic fans shall be allowed.
14. Flower Beds & Gardens
All landscaping plans that significantly change the appearance of the house must be submitted in writing to the Box Hill South Board of Directors for approval. Considerations for new beds, gardens, or trees are required as a precaution to insure that damage is avoided to any underground utility lines (i.e. electrical, sewer, cable TV, telephone) that may affect other residents. Transplanting potted plants or flowers to existing beds or gardens would not require approval by the Board of Directors. Hedges that create an enclosed area shall not be erected or maintained in front of any Lot.
Vegetable gardens can be no larger than 100-square feet and must be located in the rear of the property.
Garden borders may be approved on a case-by-case basis and may not exceed 1-foot in height from the ground surface.
15. Lawn Ornaments
Lawn ornaments erected or maintained on any Lot shall be natural wood or earth tone colors. Black, forest green, or dark brown shall be permitted.
16. Woodpiles
All woodpiles should be placed ten feet (10-feet) or more from any foundation. A maximum of one (1) cord of wood may be stored on a 4" to 12" non-corrosive pallet or platform and to a height or no more than six (6') feet. Wood should be split and neatly stacked. Open Common Areas shall not be used for woodpiles.
17. Swing Sets
The Board of Directors must approve all swing sets.
18. Pools
a. Town Homes - No swimming pool except wading pools under 2-feet in height may be placed on any Lot. No fixed base pools are allowed. All pools must be emptied by dusk.
b. Single-Family Homes - Swimming pools are permitted with written permission from the Association. The rear of the yard must be fenced in with at least a 48-inch (4-ft.) fence. (This is a Harford County Regulation for pools 2-feet and over in depth.) Above ground pools are permitted with a deck surrounding the perimeter of the pool and natural screening of trees or bushes in order to block the view of the pool from adjoining property owners.
19. Hot Tubs
Hot tubs may be installed with written permission from the Board of Directors.
20. Clotheslines
Removable umbrella clotheslines may be erected. All clotheslines must be located in the rear of the Lot and should be removed when not in actual use. Actual use shall be determined as dawn to dusk, with actual clothes being placed out to dry.
21. Patios
All patios must be approved by the Board of Directors. Patio materials may include but are not limited to, crushed stone, brick, flag stone, concrete pavers or interlocking brick, concrete slabs, field stone or slate.
22. House Exteriors
No items of material (i.e. towels, rugs, clothing) of any kind shall be hung from any exterior portion of the house, porch, deck or shed. Any changes to the exterior must be approved by the Board of Directors. Shutters may be installed on the back of the house if they are of the same existing color and style as those on the front of the house. A 'cornice' may be installed on the rear of the house provided that there is no sheltering overhang and it matches the style and color of that which is on the front of the house.
23. Mailboxes
For single-family homes only, mailbox columns made of brick or stone, 4-feet (4') in height by two-feet (2') in depth by two feet (2') in width are permitted. Two columns, one on each side of the driveway are permitted. Mailboxes made of brick should match existing brick on house.
24. Window Treatments
Window treatments should be appropriate to the home's color scheme and in relation to the general appearance of the community. Temporary window coverings (including but not limited to cardboard, newspaper, paper, sheets, etc.) shall be allowed for no more than thirty (30) days after occupancy of the home.
25. Storm Doors
The Board of Directors must approve all storm doors. Storm Doors can be full-view, full-view self-storing with a single bar, or tri-view with clear side views. Storm doors shall be factory finish white, bronze, or painted to match the existing trim color of the house. Homeowners should submit a photograph of the storm door style they are selecting, along with the color scheme of the house if the door will be a color other than white or bronze. Single-family homeowners are permitted to have ½ view storm doors with approval from the Board. Town homes must have a full-view style storm door.
26. Sheds
All sheds must be approved by the Board of Directors. Sheds shall have shingled roofs of the same color and style as those on the house. The shed color must match the house color. If the location of the shed is not against the house, the shed color can either match the house or be a semi-transparent light cedar or light cedar-toned stain. Sheds shall be constructed of wood with the exterior of the shed consisting of either aluminum siding or vinyl siding, vinyl-coated material, or painted and/or stained. The Board of Directors will review new materials in the industry as necessary.
a. The maximum dimensions of a shed in the town homes shall not exceed:
10-ft wide, 8-ft depth, and 8-ft. high (from ground level).
b. The maximum dimensions of a shed in the single-family homes shall not exceed:
14-ft. wide, 12-ft. depth, and 8-ft. high (from ground level).
All sheds must be in compliance with Harford County Building Codes, which are very specific. Please check with the Harford County Planning & Zoning (410-638-3103) for specific information on permits, restrictions, and approval of plans.
27. Awnings
No permanent or fixed awnings of any kind shall be erected or maintained on the front side of any town house or single-family home. Any awning for the rear shall be reviewed on a case-by-case basis.
28. Decks
All decks must be approved by the Board of Directors. A scale drawing with footings must be submitted for approval to the Board of Directors and a drawing or picture of the railing style is required. Homeowners must apply for a Harford County permit and meet all county codes and specifications. Decks may have square or clipped corners. Decks are restricted to one-level in the town homes. Decks will be constructed from accepted commercial decking material. Lattice may be used as a privacy screen only on the sides of the deck and not the rear section of the deck.
Town home decks on the end units may extend 3-feet (3') past the width of the house, but decks may not extend forward from the back of the house. Single-family decks must not extend past the side of the house. Off-center alignment may be approved if it meets Harford County Code. Deck lights may be approved by the Board of Directors on a case-by-case basis.
29. Fences
The Board of Directors must approve all fences. The following styles of fences are permitted in the single-family homes and town homes:
- 4' to 5' picket fences
- 4' to 6' privacy board on board
- 4' to 5' split rail (2 or 3 rails permitted)
- 4' to 6' vinyl fences
30. Stains for Decks and Fences
Decks and fences may be treated and stained in a natural wood finish or light cedar tone. Any other color must be approved by the Board of Directors.
31. Lattice Around Heat Pumps
Lattice work may be placed around heat pumps/air conditioning units provided it is no higher than the unit.
