Meeting Minutes

September15, 2004

Sue Perouty, President of the Board of Directors for Box Hill South Homeowners Association, called the meeting to order at 7 PM. The meeting took place in the conference room of Trenton Property Services, Inc. (TPSI) at 126 S. Main Street in Bel Air, MD.

Present: Sue Perouty, Jennifer Bergquist, Sally Raphel, Tom Pearson, Frank German, Rob Furlong and Sallie W. Foster with TPSI.

Visitor: Rick Drury, legal counsel for BHSHOA.

Rick Drury informed the board that the board had the authority to establish the Rules & Regulations. The final version of the Rules & Regs should be sent out to the homeowners who then have 20 days to voice their hearing or comments. The board should listen to their comments but does not have to comply. The board has the sole power to approve the Rules & Regulations. Once the board approves them, they need to be filed in the Homeowner Depository at the Harford County Land Records. Sallie can do that.

Rick also explained that there were no provisions in the Declaration or By-laws, which permitted the association to institute a fining policy. In order to have this done, the Declaration would have to be amended and that would take 75% of the votes of all lot owners.

The board would be able to institute the following legal actions: court injunctions and self-help. Court injunctions tend to be expensive and self-help should not be done if the homeowner objects and any work to be done on their property would be considered a trespassing.

The board also talked about the towing of cars in the community. Rick said that the board definitely had the right to install signs in any desired area and to tow them. The problem that Rick perceived was that the association would have a problem trying to find a towing company that would tow when a homeowner called about a vehicle parked in an area marked for "No Parking". Sallie confirmed that she has not been able to find any towing company to accomplish this. All towing companies want a representative from TPSI to call with a code word or fax the information on letterhead. Sallie to continue to look for a new tow company. The board will do an investigation of the streets to determine where they would like to have signs placed.

At the end of discussion, Mr. Drury left the meeting.

Minutes

The minutes of the August 18, 2004 meeting were reviewed and approved as read.

Financial

Sallie reviewed the financial statement and reported that everything looked good. The board will be working on a new budget for 2005 soon.

Sallie then reviewed her Manager's Report

Action Items

1. Drury - spoke at the beginning of the meeting.

2. New board appointment. Sallie had called Rhonda Biskup of 3229 Stone Eagle Court and left a message asking her if she would like to be on the board. Sallie never received a return phone call.

3. Tree behind 3202 Meadow Valley Road. The owners asked the board to remove the tree because it was dropping branches on their pool. The board discussed their options. Motion by Sue to let the owners remove the tree by a licensed tree professional if they wanted to and pay for it themselves. Motion seconded by Jennifer and approved unanimously.

4. Harford Sanitation - final discussion of the dumpster weekend. HSS said that they dropped off nine (9) dumpsters and make fifteen (15) pick up loads on the Monday and Tuesday following the Dumpster Weekend.

5. Sallie presented the new grounds contract from Ivy Hill for the board to review. It has an increase of approximately 6%. There has not been any increase in the contract for 5 years. Motion by Sally Raphel to approve contract with Ivy Hill. Motion seconded by Rob and approved unanimously. Sue Perouty signed the contract.

6. Sallie presented the new snow contract with Tri-County Unlimited. There was no increase in price. Motion by Rob to approve the contract. Motion seconded by Sue and approved unanimously. Sue Perouty signed the contract.

Correspondence

The board reviewed the correspondence that was mailed out this past month. A motion was made by Rob to have the yellow paint cleaned up off Raccoon Court spilled by the new owner of 3338 Raccoon and have it charged to their account. Motion seconded by Sue and approved unanimously. Sallie to have work done.

Legal

The board to review the legal accounts on their own.

Old Business

1. Newsletter to go out by end of month per Jennifer.

2. Sallie instructed to price "No Towing" signs by Peachtree and All Signs.

New Business

1. Sallie presented a new contract from TPSI. There was an increase for a 2-year contract and an alternate increase if a 3-year contract was signed. The board to review the contract on their own time.

The meeting adjourned at 9:35 PM.
